Introduction

This Privacy Policy describes the types of information Mentalzon, a ("Mentalzon", "we", or "us"), may collect from you or that you may provide when you visit the website, located at Mentalzon (our “Site”), and our practices for collecting, using, maintaining, protecting, and disclosing that information in connection with the services offered by Mentalzon through the Site (the “Services”). Please read this Privacy Policy carefully to understand our policies and practices regarding your information. If you do not agree with our policies and practices, your choice is not to use our Site. By accessing or using this Site, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of this Site after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates.

This Privacy Policy, together with the Terms of Service of Mentalzon, located at Terms of Use (the “Terms”), constitute a legal agreement (the “Agreement”) between you and Mentalzon. All terms not defined here are defined in the Terms.

Types of Information We Collect

Personal Information. Our Site may collect information that personally identifies you (“Personal Information”), which may include, but is not limited to, the following: full name; phone number; email address; credit card information; health insurance plan; messages to a therapist offering services through the Site (“Therapist”) regarding why you are reaching out; employment, including whether you are a student and, if so, which university you attend; and how you heard about the Company (e.g., through a friend, Google search, etc.).

Aggregate and Anonymous Data. Our Site may also aggregate and collect anonymous data that does not identify you specifically, including data collected automatically when you enter our Site (“Non-Personal Data”). This may include cookies, pixel tags, web beacons, browser analysis tools and web server logs. This also includes information from the devices you use to access our Site or mobile platform, your operating system, type of mobile device model, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone of your device. Our server logs may also record the IP addresses of the devices you use to interact with the Site. We may also collect information about a website you were visiting before you came to our Site and any website you visit after you leave our Site, if this information is supplied to us by your browser. We may also use software tools, such as Javascript, to measure and collect session information, including page response times, download errors, and methods used to browse away from the page. Non-Personal Data also includes some data collected by location services.

HIPAA Compliance

If any of the Services Mentalzon providers are subject to the Health Insurance Portability and Accountability Act (“HIPAA”), we will have privacy and security obligations set forth our Business Associates Agreement, which is incorporated herein by reference, in addition to those described in this Privacy Policy.

Children's Privacy

Under Age 16

Our Site is not intended for children under 16 years of age. No one under the age of 16 may provide any personal information on the Site. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on this Site or utilize any of its features, register on the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us at [email protected].

Under Age 18

Minors under 18 years of age may have the Personal Information that they have provide to Mentalzon through the Site deleted by sending an email to [email protected] requesting deletion.  Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.

When We Collect Personal Information

We collect your Personal Information when you interact with the Site, including when you do any of the following on the Site:

  • Contact a Therapist through the Site;
  • Book a phone consultation with a Therapist via our Site;
  • Post or comment on a video or article or send an email to us;
  • Subscribe to our mailing list;
  • Register as a Therapist to be listed in our directories. We collect Personal Information to create your profile in the directory, such as name, address, email address, as well as professional information, including your qualifications, certifications, the geographic region in which you practice, and your fields of specialty. We collect additional information for our records that may not be displayed as part of your directory profile but is necessary to check the information you provide or accept payment from you; or
  • Open an email communication from us in your email program. We may use a software technology called “web beacons” that lets us know which emails have been opened by the recipients. This allows us to know how users respond to certain communications and the effectiveness of our marketing campaigns.

We also collect your Personal Information through third party service providers. Currently, we use Acuity Scheduling to book calls between users of the Services (“Users”) and Therapists, and Amazon Web Services (“AWS”) to relay messages between parties using the Site. While these may not be the third parties that we use in the future, we may use other companies like them to collect Personal Information.

How We Use Your Personal Information and Non-Personal Data

We use Personal Information and Non-Personal Data to:

  • Build, operate and improve our Site and the Services;
  • Provide you with the Services;
  • Perform user analytics;
  • Provide customer support;
  • Communicate with you and provide additional information that may be of interest to you, such as newsletters;
  • Enforce our Terms and this Privacy Policy;
  • Fulfill our legal obligations and respond to any litigation or law enforcement/government inquiry;
  • Disclose as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to protect our operations or those of any of our affiliates; (c) to protect our rights, privacy, safety or property, or property that belongs to you or others; or (d) to allow us to pursue available remedies or limit the damages that we may sustain;
  • Send you reminders, technical notices, updates, security alerts and support, and administrative messages; and
  • Manage our everyday business needs, such as Site administration, analytics, fraud prevention, or to comply with the law.

We do not sell any Personal Information about Users or Therapists.

When and Why We Disclose Personal Information and Non-Personal Data

We may disclose Personal Information that we collect or you provide as described in this Privacy Policy:

  • To our subsidiaries and affiliates;
  • To Therapists who provide the Services;
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them (for example, we may provide your email address to technical platforms that mail out our newsletters);
  • To licensing boards to check Therapists' credentials;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Mentalzon's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Mentalzon about our Users is among the assets transferred;
  • To fulfill the purpose for which you provide it;
  • For any other purpose disclosed by us when you provide the information; or
  • With your consent.

We May Also Disclose Your Personal Information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce or apply our Terms; or
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Mentalzon, our Users, Therapists, or others.

We may share Non-Personal Data with analytics companies to learn information about how our Users interact with the Site. This enables us to optimize the Service and improve our efforts. These analytics services may use cookies, web beacons and other devices and technologies to track traffic data. Data that they collect typically includes, but is not limited to, your IP address, your ISP, the browser you use to visit our Site. This Privacy Policy does not apply to, and we are not responsible for, such technologies placed by third party analytics services.  We may also share Personal Information, specifically your email address, with social media platforms solely for the purpose of creating targeted audiences for our social media advertising.

Links to Other Sites and Third-Party Tracking Technologies

Some content, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. When you click on links and/or ad banners that take you to third-party websites, the third party may collect information about you at their website. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. The third party may have its own privacy policies that differ from ours. Data Security

The security of your data is very important to Mentalzon. We have implemented appropriate security measures preventing your Personal Information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. However, you should know that no website operator, including Mentalzon, can fully eliminate security risks associated with Personal Information. While Mentalzon has endeavored to create a secure and reliable website for Users, the confidentiality of any communication or material transmitted to/from the Site or via e-mail cannot be guaranteed.

The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Of special consideration are work email, school, or institutional email addresses. For example, if you use your work email to communicate, your employer may have legal access your email communications. We urge you to be careful about giving out information in public areas of the Site. The information you share in public areas may be viewed by any User or Therapist of the Site. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Site. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Accessing and Correcting Your Information

You can review and change your personal information by logging into the Site and visiting your account profile page.

You may also send us an email at [email protected] to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Content from the Site, copies of your User Content may remain viewable in cached and archived pages, or might have been copied or stored by other Site users.  Proper access and use of information provided on the Site, including User Content, is governed by our terms of use.

We do not sell your Personal Information.

Your exercise of these rights will have no adverse effect on the price and quality of our goods or services.

Response to “Do Not Track” Signals

Some Internet browsers include the ability to transmit “Do Not Track” signals. Since uniform standards for “Do Not Track” signals have not yet been adopted, Mentalzon does not process or respond to “Do Not Track” signals.

Amendments

This Privacy Policy may be revised from time to time as we add new features and services, as laws change, and as industry privacy and security best practices evolve.  We display an effective date on the policy in the upper left corner of this Privacy Policy so that it will be easier for you to know when there has been a change.  If we make any change to this Privacy Policy regarding use or disclosure of Personal Information, we will provide advance notice on the Site.  Small changes or changes that do not significantly affect individual privacy interests may be made at any time and without prior notice.

Limitation of Liability for Privacy

YOU UNDERSTAND AND AGREE THAT ANY DISPUTE OVER PRIVACY IS SUBJECT TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND MENTALZON'S TERMS OF SERVICE (INCLUDING ANY INDEMNIFICATION AND LIMITATIONS ON DAMAGES CONTAINED THEREIN).

We do not make any representation or warranty that this Site is appropriate or available for use in any particular jurisdiction and we do not knowingly collect Personal Information from jurisdictions outside of the United States of America.
